<span style="color: black;">This article deals with the issue of divorce in Islam, because this </span><span style="color: black;">issue
 is a burning issue in India now. It is a hot issue in India as the 
triple instant divorce was ruled as unconstitutional by a bench of 
judges in Supreme Court. And this is why this article has been prepared 
in this time particularly.</span></h4>
<h2 style="text-align: left;">
<b><span style="color: teal;">The Meaning of Talaq (Divorce) literally and in Terminology</span></b></h2>
<h4 style="text-align: left;">
<i>Talaq</i> (Divorce) in the Arabic language in general refers to abandoning, setting free or releasing.<br />
However, in Islamic jurisprudential term, <i>talaq</i> means termination of the bond of marriage with a specific word by the husband. In other words, <i>talaq</i> is ending the legitimacy of sexual intercourse between husband and wife.</h4>
<h2 style="text-align: left;">
<b><span style="color: teal;">What is Talaq (Divorce)?</span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;">The verdict of Islamic
 Jurisprudence about divorce might be weird to some Muslims and 
non-Muslims in general when they will hear for the first time that if a 
Muslim husband says to his wife: “you are divorced” or “I have divorced 
you” or other phrases that have been assigned for divorce in Arabic or 
other languages of the world, the divorce becomes effective instantly, 
even if the husband has just pronounced the word to joke or laugh. This 
is the ruling in Islamic jurisprudence regarding pronouncing the phrase,
 irrespective of the fact that the husband said the word in the presence
 of his wife or in her absence or there was any witness or not, in all 
cases the phrase of divorce becomes effective. However, they may need to
 authenticate in a written form with the related official authorities. 
Once, the husband has uttered the phrases of divorce the couple becomes 
strange to each other and the blessed marriage relation is broken, and 
it is useless to say then:” I did not know the ruling,” “I did not mean 
it,” or “I love my wife.” Suppose, if both are living with each other as
 husband and wife after the divorce, they will be regarded as sinners in
 Islamic Shari`ah. If the divorce is revocable, the husband has the 
right to bring her back to the bond of marriage during the period of </span>Iddah (waiting time for women after divorce). If the period of <span style="color: black;">`Iddah
 elapses, the only legal way for them is to make a new marriage 
agreement with a new marriage gift to her with new witnesses. However, 
if the divorce has been made thrice, the wife will not be allowed to 
return to the same man again unless she gets married with another man by
 her free will and after that she </span><span style="color: black;">again </span><span style="color: black;"> is divorced by her new husband by his free will without prior agreement. By then, she can return to her first man with new marriage.</span></h4>

<b><span style="color: teal;">Divorce is like a Knife</span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;">Divorce in Islam is like a knife that 
is used for kitchen purposes, and when it is used in good things it is 
good and useful, but sometimes the knife falls into the hand of a 
criminal who uses it to kill an innocent person and at that time the 
usage is evil and harmful.</span><br />
<span style="color: black;">If a husband uses the right of divorce to 
terminate the marriage relationship when the life of the couple becomes 
unbearable hell, and the continuation of life together as husband and 
wife becomes impossible for some true reason, like constant quarrel, 
infertility of one of the spouses or they do not want to stay together, 
at this time the divorce is a normal and becomes an important treatment 
of the problem. And if the right of divorce was used, at this time, it 
is surely good and beneficial. But, when the right of divorce is used to
 harass a woman or humiliate her or to cut the marital relationship 
without a valid and reasonable cause, then undoubtedly it is an evil act
 and harmful thing. </span><br />
<span style="color: black;">Divorce in Islamic law is a very serious 
issue. In fact, the option of divorce reflects the true inclination of 
Islam for solving some important problems in marital life.</span></h4>

<span style="color: teal;"><b>Divorce via Telephone and Text messages</b> </span></h2>
<h4 style="text-align: left;">
<span style="color: black;">As all financial contracts and 
transactions are carried out through modern means, the same the divorce 
is effective through all means of modern social communication, through 
letters, text messages, telephone, email, etc.</span></h4>
<h2 style="text-align: left;">
<b><span style="color: teal;">Minimum and Maximum Number of Divorces</span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;">According to Islamic Shari`ah, the 
maximum number of divorces is three, the minimum is one. In addition, 
the divorce is of three categories; the first, the divorce that gives 
both the right of returning to each other with their personal and 
individual reconciliation and this is called in Islamic jurisprudence “<i>Raj`ee Talaq</i>” (revocable). The second is <i>“Talaq Ba’in sughra” </i>(semi-irrevocable)
 when the divorce takes place and the days of `iddah ends without 
returning the wife. In this case, they can make marriage again with new 
marriage contract. The third <i>“Talaq Mughallazah”</i> (irrevocable 
divorce), and this ruling comes when a husband divorces three times. In 
this case, they are not allowed to return to each other even with a new 
marriage, except after she gets married to another man and get divorced 
again. </span><br />
<span style="color: black;">We can liken the divorce in Islam to 
firing with a gun or throwing an arrow which will wound someone or 
something in, whether the archer is serious or just joking, it will 
leave its impact without doubt.</span></h4>

<b><span style="color: teal;">What is <i>Talaq</i> (Divorce) in Islam?</span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;">There is another classification of 
divorce in terms of agreeing or violating the teachings of Qur’an and 
Sunnah. From this angle, the divorce is three types: better, good, and 
bad. </span></h4>
<h2 style="text-align: left;">
<b><span style="color: black;"><span style="color: teal;">The First Category of Divorce</span> </span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;">The first category of divorce is that 
which is given by a husband to the wife during her purity from 
menstruation during which they did not have a sexual intercourse and she
 is left until her three periods are finished and now they became 
strange to each other.</span></h4>
<h2 style="text-align: left;">
<b><span style="color: black;"><span style="color: teal;">The Second Category of Divorce</span> </span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;">The second is the good and this is when
 a husband divorces his wife thrice distributed on three periods, each 
divorce on each period of purity from her menstruation. </span></h4>
<h2 style="text-align: left;">
<b><span style="color: teal;">The Third Category of Divorce  </span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;"> The third is the bad or heretical one 
which this applies when a husband divorces his wife randomly three 
divorces in one phrase, such as: “Three divorces are to you” or “I 
divorce you the three divorces”. And the question is if a husband 
divorces his wife the three divorces in one word or on the bad way what 
is the ruling? Is the divorce effective or not, will the divorce be 
counted or not. In this regard, the four authentic schools of Islamic 
jurisprudence view that the divorce is effective and the wife and 
husband become strange to each other, however, the husband is sinner and
 violator the tradition of the Prophet (peace be upon him).</span></h4>
<h2 style="text-align: left;">
<b><span style="color: teal;">Different Schools of Islamic Jurisprudence on the Instant Triple Talaq </span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;">It is worth-mentioning that the instant
 triple talaq is a disputed issue amongst the Muslim jurists. And there 
is more than one opinion in this subject.<br />
One of the opinions says that the way of divorce is deifying the 
instruction of Islamic Shari`ah, therefore, the instant triple talaq is 
nothing, fruitless and useless and no divorce will happen. This view has
 been attributed to some Tabi`een or the students of the companions of 
the Prophet Muhammad (peace be upon him).<br />
In addition, there is another opinion that concludes that in the case of
 instant triple talaq only one divorce will occur and the spouses can 
reconcile with each other and they will remain husband and wife. And 
this conclusion has been attributed to Ibn Taymiyah (1263- 1328 A.D.) 
and his pupil Ibn al-Qayyim((1292–1350 A.D.) the famous and great 
scholars of Islam.<br />
Nevertheless, the issue of talaq (divorce) belongs to the Muslims, and 
the ruling is one of the Islamic personal laws of the Muslim family, so 
it is unreasonable to intervene in this matter by any party except the 
Muslim scholars and jurists.</span></h4>
<h4 style="text-align: left;">
<span style="color: black;">It is noteworthy that this is the issue the Indian bench of judges has regarded as unconstitutional. The triple <i>talaq</i> or instant <i>talaq</i> in Islam is a burning issue in India.</span></h4>
<h2 style="text-align: left;">
<b><span style="color: teal;">The Right of Divorce for Woman</span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;">It is noteworthy that a wife also has the right of separation from her husband which is called in Islamic jurisprudence <i>“Khul`a”</i>. So <i>Khul`a</i> is not instant but it is a procedure through which a woman can divorce her husband. In Islam, the right of <i>khula`</i>
 for a wife refutes the claim of some people who think that a wife has 
no right to divorce even if she is not happy with her husband or if 
there is an irremediable marital problem. Divorce in Islam is like a 
bitter medicine or surgery, which is used only when it is necessary. 
However, some Muslims now use divorce as the food, not like the medicine
 and this is the real problem. As well as, the divorce is the most 
detest thing to Allah the Almighty. Allah has permitted for divorce but 
that does not mean that it is something pleasant to Allah and the 
Messenger (peace be upon him).</span></h4>
<h2 style="text-align: left;">
<b><span style="color: teal;">Divorce in Hinduism</span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;">In this context, it is necessary to refer to the idea of divorce in Hinduism.
 In fact, the ancient Hindu literature does not have the concept of 
divorce as well as the Sanskrit and Hindi language is void of the word 
of talaq or divorce. The word talaq in Hindi now has been borrowed from 
Arabic and Urdu. According to Hinduism, if her husband dies, she must 
burn herself with her husband’s dead body and this is called Sati. On 
the other hand, some Hindu commentators think that the burning in Sati 
tradition is metaphor that means a widow has to burn her desires in life
 totally. If she lives, lives like a dead, her eating must be simple 
away from pleasure and her dress must be free of adornment, as it is not
 permissible for her to marry a second marriage. Additionally a wife may
 establish a sexual relationship with a foreign man to obtain children 
if her husband is barren and this is called <i>Neog</i> and the type 
of sexual intercourse is permissible, rather a meritorious action. 
However, there is a clear change in the tradition of Sati and in the 
prohibition of second marriage for a woman specially after the advent of
 Islam to the Indian subcontinent.</span></h4>
<h2 style="text-align: left;">
<b><span style="color: teal;">What is <i>Halalah</i> in Islam?</span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;"><i>Halalah</i> is the second marriage
 of a woman who was divorced three divorces from her husband and became 
strange to him and both became separated. After that the woman was 
married to another man with her choice and free will but by chance the 
second marriage was also unsuccessful and ended on divorce, then the 
divorced woman after waiting three periods is allowed to return to first
 husband through a new marriage. The marriage of the divorcee with 
another man without prior agreement for divorce is called <i>Halalah</i> (permission) because this marriage if divorce follows is permission for her to return to the first Husband.</span></h4>
<h2 style="text-align: left;">
<b><span style="color: teal;">Is <i>Halalah</i> Permissible in Islam?</span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;">The scholars of Islam view that 
marriage for a fixed time or temporary marriage is prohibited and 
against the Islamic law, and if any person marries for definite period, 
or intends to become a mediator and justification for her return to the 
first husband -as sometimes happens in Muslim families in India- is not 
permissible in Islam, rather, this act causes the anger of Allah the 
Almighty and everyone who conducts or officiates such marriages deserves
 curse from Allah the Almighty.</span></h4>

<b><span style="color: black;"><span style="color: teal;">Conclusion</span></span></b></h2>
<h4 style="text-align: left;">
<span style="color: black;"> The issue of instant triple <i>talaq</i>
 (divorce) is surely contrary to the spirit of Islamic law. The husband 
who gives three divorces in one word in one sitting is sinful and 
blameworthy before Allah the Almighty, because he violated the divine guidance and the command of the Prophet Muhammad
 (peace be upon him) although the divorce is effective. If a person 
utters foul word or insulting phrase the word will hurt the addressee 
who will be angry once the word is heard and the excuse of ignorance and
 forgetfulness will not work. It is recommended for the girls and boys 
who are ready for marriage to study the issues of divorce and marriage,
 rights and duties, because this will help to continue the marital 
relationship and avoid the family problems. The solution is not to 
cancel the triple instant divorces, if people began violating the 
traffic rules we will not abolish the traffic rules rather we will try 
to make people aware of the rules.</span></h4>

 worships One God, Who has no partner and Who has the Most Beautiful 
Names and the Highest Attributes. Thus, the Muslim’s focus and aim is 
concentrated, focused on His Lord and Creator; he puts his trust in Him 
and asks Him for help, patience and support; he believes that Allah is 
Able to do all things, and has no need of a wife or son. Allah created 
the heavens and earth; He is the One Who gives life and death; He is the
 Creator and Sustainer from Whom the slave seeks provision. He is the 
All-Hearing, Who responds to the supplication of His slave, and from 
Whom the slave hopes for a response. He is the All-Merciful and 
All-Forgiving, to Whom the slave turns in repentance when he has 
committed a sin or fallen short in his worship of Allah. He is the 
Omniscient and All-Seeing, who knows all intentions and what is hidden 
in people’s hearts. The slave feels ashamed to commit a sin by doing 
wrong to himself or to others, because his Lord is watching over him and
 sees all that he does. He knows that Allah is All-Wise, the Seer of the
 Unseen, so he trusts that what Allah decrees for him is good; he knows 
that Allah will never be unjust to him, and that everything that Allah 
decrees for him is good, even if he does not understand the wisdom 
behind it.</h4>

<b>Effects of </b><b>Prayer</b></h4>

 of the Muslim.It keeps the slave in contact with his Lord; if he enters
 it in a spirit of devotion and concentration, he will feel tranquil and
 secure, because he is asking the Most Powerful, Allah (Glorified and 
Exaltedbe He). For this reason, the Prophet Muhammad
 (peace be upon him) used to say: “Let us find relaxation and joy in 
prayer.” If something distressed him, he would hasten to pray. Everyone 
who finds himself faced with disaster and tries prayer finds strength, 
patience and consolation.</h4>

burdensome, like man-made taxes; it is only 25 in every thousand, which 
the sincere Muslim pays willingly and does not try to evade or wait

Islam commands
 all kinds of good and forbids all kinds of evil. It encourages good 
manners and proper treatment of others. It enjoins good characteristics 
such as truthfulness, patience, kindness, humbleness, modesty, keeping 
promises, dignity, mercy, justice, courage, patience, friendliness, 
contentment, chastity, good treatment, tolerance, trustworthiness, 
gratitude for favors, and self-control in times of anger. Islam commands
 the Muslim to fulfill his duty towards his parents and to uphold family
 ties, to help the needy, to treat neighbors well, to protect and 
safeguard the wealth of the orphan, to be gentle with the young and show
 respect to the old, to be kind to servants and animals, to remove 
harmful things from the road, to speak kind words, to forgive at the 
time when one has the opportunity to take revenge, to be sincere towards
 one’s fellow-Muslims, to meet the needs of the Muslims, to give the 
debtor time to repay his debt, to prefer others over oneself, to console
 others, to greet people with a smiling face, to visit the sick, to 
support the one who is oppressed, to give gifts to friends, to honor his
 guest, to treat his wife kindly and spend on her and her children, to 
spread the greeting of peace (salam) and to seek permission before 
entering another person’s house, lest one see something private that the
 other person does not want one to see.</h4>

Some non-Muslims may do these things out
 of politeness or good manners, but they are not seeking reward from 
Allah or salvation of the Day of Judgment.</h4>

 we will find that it is in the interests of both the individual and 
society as a whole. All these prohibitions serve to safeguard the 
relationship between the slave and his Lord, and the relationship of the

them together; belief in the influence of the stars on events and 
people’s lives; cursing time, because Allah is directing its affairs; 
and superstition, because this is pessimism.</h4>

<b>Wisdom behind Islamic Morals</b></h4>

by showing off, boasting or reminding others of one’s favors; bowing or 
prostrating to anything other than Allah; sitting with hypocrites or 
immoral people for the purposes of enjoying their company or keeping 
them company; and invoking the Curse or Wrath of Allah on one another or
 damning one another to Hell.</h4>

Islam forbids the Muslim to raise his 
voice in prayer, lest it disturb other believers; to continue offering 
supererogatory prayers at night when one feels drowsy – such a person 
should sleep then get up; to stay up all night in prayer, especially one
 night after another; and to stop praying when there is doubt as to the 
validity of one’s Wudu’ (ablution).</h4>

Islam forbids buying, selling and making
 “lost and found” announcements in the mosque-because it is the place of
 worship and remembrance of Allah, where worldly affairs have no place.</h4>

 forbids to boast about the cost of building a mosque; to decorate a 
mosque with red or yellow paint or adornments which will distract the

Islam forbids sitting on the graves or 
taking graves as places of worship. Islam forbids wailing, tearing one’s

Among the features and merits of Islamic
 rulings that is most important is that they are Divine and Godly; the 
source of these rulings is Allah Almighty, Who is the Creator and Wise, 
no error or forgetfulness can creep into them. The system of Islamic 
rulings is all-inclusive that includes all provisions on religion, 
worship, dealings, war and peace, governance, policy, system of morals 
and behavior, system of divinity and spirituality. It is different from 
many of the religions of the world that may include the system of morals
 and spirituality but devoid of politics, governance and political 
system, like Christianity.</h4>

Some religions belong to a particular 
community and lineage, like Judaism, but Islam is the universal and 
general for mankind. Some religions were distorted and altered and did 
not remain safe from the hands of humans, as happened with Judaism, 
Christianity and Hinduism. However, Islam is the only religion that was 
saved with its provisions and laws represented in the Glorious Qur’an 
and Sunnah. There are millions of Muslims who memorize the whole 
Glorious Qur’an, word by word by heart. Such features could not be found
 in any religion of the world. That is why Islam is more entitled to be 
followed in all subjects of life.</h4>

Principles and rules of Islam are most 
reasonable, realistic and proved. Muslim scholars have written special 
books on the principles and beliefs of the Islamic Shari`ah and provided
 rational proofs highlighting the causes, secrets, expediencies of its 
provisions and rules. In these books, the principles and rules of Islam 
have been shown to be according to sound reason, right understanding and
 true nature. If any person raised any objection on any religious 
question, Muslim scholars would give a very reasonable, logical and 
complete answer to it.</h4>

We present here some characteristics of Islamic Shari`ah or merits of Islamic rulings:

<h4 style="text-align: left;">
<b>The First Merit:</b> Islam 
has introduced to such wonderful ways of devotion and worship of Allah 
that could not be found in any revealed book or in any religion of the 
world. The system of worship in Islam is well defined, systematic, pure,
 monotheistic and coinciding with the nature and need of human being.<br />
<b>The Second Merit</b>: Islam has given thorough details of the 
obligations towards Allah, towards self and towards fellow beings; even a
 hundredth part of which is not to be found in any other religion.<br />
<b>The Third Merit</b>: No constitution and no law can compete with the 
perfect political system and rules of justice, administration and 
international security that are presented by Islam. For instance, take 
the constitution and Law of America, or any other country; you will find
 by going through them that they are based on the expediencies of a 
particular territory, and whichever law is enacted, it will be found to 
contain particularly the element of domination and preference of a 
particular nation and a particular territory. On the contrary, the law 
promulgated by Islam, enunciates the rights of mankind without 
distinction of race and color. No branch of Islamic law is based on the 
interests and objects of any particular territory and particular race. 
The proof of this is that whenever any problem emerges in the world, 
whether it is about the agreement and treaty with any nation or about 
war, whether it is about the internal administration or foreign policy’ 
of the country, a commandment relating to it will certainly be found in 
Shari`ah.</h4>

<h4 style="text-align: left;">
In Akbarabad (Agra), India, an 
Englishman demanded proof of the truth of Islam from a Muslim scholar. 
The scholar gave some proof about the truth of Islam and related the 
miracles of the Prophet (peace be upon him) which proved him to be a 
true Prophet of Allah. The Englishman admitted the truth of these proofs
 but said that there was one more convincing proof about the truth of 
Islam. He said that their English constitutional and administrative law 
was framed with the deliberations and consultations of hundreds of wise 
men and politicians of the country and was completed in hundreds of 
years, in spite of all this, some law or the other needs amendments and 
alterations every four or five years. On the other hand, the law of 
Shari`ah was formed in a period of 23 years by the tongue of a person 
not knowing reading and writing, without the consultation of anybody, 
and no amendment and alteration was needed in it until now, nor did it 
show any sign of weakness in its stability and accuracy. Such a complete
 and extensive constitution and code cannot be made without revelation 
from Allah. The scholar then inquired of that Englishman as to why he 
did not embrace Islam. He replied that if he did so, his service and 
salary would come to an end. On hearing this, the scholar was silent. 
Afterwards, the Englishman embraced Islam. (`Ubaydullah, Tuhfatul Hind, p
 240).<br />
<b>The Fourth Merit:</b> No other religion contains even a shadow of the
 science of ethics and manners as contained in Islam. This will be 
proved by a perusal of the books “Ihya-ul-`Ulum” and “Kimya’e-Sa`adat” 
by Imam Gazali (may Allah have mercy on him). All these precious rules 
and principles were taken and extracted from the Glorious Qur’an and 
Sayings of the Prophet Muhammad (peace be upon him).<br />

We call all people; those with a 
religion and those who do not profess any religion to come to know the 
spiritual and worldly advantages of Islam, read about it and explore its
 beauty. Message of Islam is not aimed at a certain group of people or 
people in a certain locality; it is for everyone and everywhere.</h4>

<h4 style="text-align: left;">
The Islamic way of life is a practical 
one, it is not beyond the human strength, but according to his ability, 
the provisions of Islam have been applied almost a thousand years in all
 parts of the Muslim world. The Muslim world did not lag behind in 
prosperity and progress but when failed in the application of those 
provisions.</h4>
<h4 style="text-align: left;">
</h4>
<h4 style="text-align: left;">
The first part of this article has presented some characteristics of Islamic Shari`ah, now the rest part goes on as follows:</h4>
<h4 style="text-align: left;">
</h4>
<h4 style="text-align: left;">
<b>The Fifth Merit</b>: No other 
religion contains the injunctions about the prevention and restraint of 
the carnal desires, evil instincts and worldly pleasures and about the 
protection of the chastity and character of women as found in Islam.<br />
Islam enjoined Hijab on women and prohibited men from casting their 
looks on women, so that the chastity and character of women may not be 
tarnished and offspring or progeny may not become doubtful.</h4>
<h4 style="text-align: left;">
</h4>
<h4 style="text-align: left;">
Islam has prohibited dance before 
marriageable men because it excites carnal instincts and leads to sexual
 violence and harassment.<br />
Islam has prohibited alcoholic drink because it takes away the ability 
of reasoning which is the most valuable gift from Allah Almighty for 
mankind. Therefore, Islamic Shari`ah has prohibited all kinds of drugs 
and intoxicating materials that cause the destruction and annihilation 
of reasoning power and thinking ability. People should be thankful to 
Islam which has protected our mind and reasoning capabilities, upon 
which depend our faith and all worldly affairs.<br />
Islam has prohibited usury and gambling that are the causes of man’s spiritual and ethical collapse. Islam enjoins you to give ‘<i>Qard Hasan</i>‘
 (loan without interest) to others when they need it. That is, you 
should help them by offering loan without interest because interest  in 
Islam has been regarded a sort of charity. Help the needy when they are 
in need and give loans to them without making them feel obliged. Allah 
is not Kind to one who is not kind to men. This is the teaching of 
Islam.<br />
The creed of usury tells you that you should take advantage of the 
miseries and needs of the needy, and should increase wealth by giving 
loan on interest to them, without doing any work or labor. If the debtor
 is unable to pay the debt in time, give him further time with a smiling
 face, so that the interest is doubled and tripled and you may 
eventually put his house and property to auction.</h4>
<h4 style="text-align: left;">
</h4>
<h4 style="text-align: left;">
The results of usury are briefly as follows:<br />
1) Mutual help and obligation come to an end.<br />
2) It makes a man hard-hearted instead of kind-hearted.<br />
3) One addicted to this evil is pleased to see others in trouble and he 
is always on the look out to find a needy person so that by showing 
sympathy, he may be able to entrap him in the net of loan and get his 
property auctioned.<br />
4) When avarice and greed of wealth increase, one’s conscience teaches one various ways of dishonesty and fraud.<br />
5) Gradually such a person becomes lazy and a pleasure-seeker. When he 
sees that he collected so much wealth to enable him to earn thousands, 
rather millions of rupees without any exertion and labor, he does not 
care to take the trouble of indulging in trade, cultivation of land or 
industry, upon which depends the progress of the country. If the 
capitalists invest their capital only to secure interest and do not 
establish any industrial factory, the country will never make any 
progress.<br />
In short, Islam has completely prohibited indulgence in revelry and 
carnal desires, and has made adequate provision for the protection of 
honor, chastity of women, lineage and progeny. It has also prohibited 
the curse of usury, because Islam does not tolerate such an acquisition 
of money which generates dishonesty, fraud, cruelty, hard-heartedness 
and pleasure over the trouble of the afflicted.<br />
Communism exhorts the poor to rob the capital of the capitalists and bring them down to the level of beggars and laborers.<br />
But Islam enjoins the rich and wealthy people to pay Zakah and to help 
the poor by giving alms to them without letting other people know of it 
in the least. It is not valid for you to let your neighbor go to bed 
hungry. When you give alms and charity to anybody, you should not press 
your obligation upon him, but you should thank Allah Who enabled you to 
help others, because if Allah loves those who help others. If any needy 
person be not inclined to accept charity, help him by giving <i>Qard Hasan</i> (Loan without interest) to him.<br />
Islam enjoins the poor not to cast their looks on the property of 
others, to remain content with their own poverty, rather, to be grateful
 to Allah because poverty is also a blessing which was conferred by 
Allah on His friends. Prophet Ibrahim, Prophet Musa and Prophet `Isa 
(peace be upon them) were blessed with the gift of poverty and He 
granted Namrud, Pharaoh and the Jews the attractive sovereignty of this 
temporary world. When the rulers of states were intoxicated with power, 
wealth and position and became as proud and haughty as to defy that 
Allah had granted them the kingdom, but Allah destroyed them all in no 
time. Now you may compare the preaching of communism with the teachings

<b>The Sixth Merit:</b> Islam is the 
gist of the messages of all Prophets and the essence of wisdom of all 
wise men. There is not a single good and virtue which has not been 
enjoined and there is not a single evil and vicious act which has not 
been prohibited. Imam Rabbani Mujaddid Alfi-Sani (May Allah have mercy 
on him) in one of his letters says:<br />
“The personality of the Prophet Muhammad, the Messenger of Allah, (peace
 be upon him) was the reflection of all the attributes and virtues. The 
Book which was revealed on him namely the Glorious Qur’an is the gist of
 all Divine Books which were revealed on all Prophets, his Shari`ah is 
the gist and essence of all rulings and practices of previous Messengers
 and Prophets. Religious rituals of his Shari`ah are the combinations of
 devotional acts of the angels and of the whole universe. Some angels 
are ordained to undertake <i>Ruku`</i> (bowing) some Sajdah (prostration) some <i>Qiyam</i> (standing straight). In Salah (Prayer), all these practices of angels are combined.</h4>
<h4 style="text-align: left;">

<h4 style="text-align: left;">
Some previous nations had only the 
Morning Prayer as obligatory, while others had other prayers but on this
 nation, nation of Islam all prayers have been made obligatory. The 
religious acts of this nation are the combination of the different 
religious rituals of the earlier nations. Therefore, to act according to
 the Shari`ah of Prophet Muhammad (peace be upon him), is in fact, to 
act according to Shari`ah of all Prophets and Messengers (peace be upon 
them) in reward; and to deny the Shari`ah of Prophet Muhammad (peace be 
upon him) is to deny Shari’ah of all Prophets and Messengers.</h4>

<h4 style="text-align: left;">
To believe in our Prophet (peace be upon
 him) is to believe in all Prophets and Messengers (peace be upon them).
 As well as to deny him is in fact, to deny all Prophets and Messengers.
 Therefore, the believers in him are the best nation and the deniers of 
him are the worst in nations.” (Extract from 79th Maktub, from Chapter 
First (Daftare Awwal).</h4>

<h4 style="text-align: left;">
In fact, Islam encompasses all the 
beauties and perfections that were scattered in the messages of all the 
Prophets and Messengers, as the message of Islam is the final and last 
Message of Allah, there will be neither any prophet nor messenger after 
the final Messenger Muhammad (peace be upon him).</h4>
<h4 style="text-align: left;">
</h4>
<h4 style="text-align: left;">
<b>The Seventh Merit:</b> The economic 
law of Islam is based on the principle of social equality; no one should
 be left poor or deprived. It is the primary duty of an Islamic State 
that it should establish Public Treasury and collect Zakah, charities 
and other alms to spend them on the poor and the destitute. It is also 
the duty of an Islamic State that if any non-Muslim is unable to earn 
livelihood, he should be maintained from the Public Treasury of the 
Islamic State.</h4>
<h4 style="text-align: left;">

<h4 style="text-align: left;">
<b>The Eighth Merit:</b> The judicial 
and criminal system of Islam is fully responsible for maintenance of 
public peace and order. It puts strict procedures and punishments that 
are able to stop heinous crimes, such as theft and adultery.</h4>
<h4 style="text-align: left;">
</h4>
<h4 style="text-align: left;">
The present form of administrations not 
only fails to prevent the theft and adultery, but allows them to 
increase day by day. The simpletons regard it as progress and personal 
freedom or human rights while they regard Islamic penal law to be 
barbarous. There is no room for the thieves and the bad characters in 
the Islamic law as was said: “It is as bad to do good to the bad as to 
do evil to the good.”</h4>
<h4 style="text-align: left;">
</h4>
<h4 style="text-align: left;">
The fact that a particular law of the 
land creates anxiety among the thieves and the bad characters is a clear
 proof of that law being just and right. Therefore, the fact that 
Islamic penal law makes the thieves and knaves worried is a clear proof 
of its being just and right.</h4>
<h4 style="text-align: left;">
</h4>
<h4 style="text-align: left;">
<b>The Ninth Merit:</b> It is also among
 the merits of Islamic rulings that  Islamic law is plain and clear and 
not vague or complicated. The Islamic law does not tolerate that a case 
should remain pending for tens of years and the time and money of the 
parties should be wasted on the hearings; and the court that fails to 
grasp the facts of each case within a reasonable time is in all 
probability itself afflicted with the evils of bribery and corruption.</h4>
<h4 style="text-align: left;">

<h4 style="text-align: justify;">
In Islamic law there is no room for a 
barrister or an advocate to prove the truth as falsehood and vice versa.
 The law which is so flexible that an advocate may turn it in any 
direction he pleases cannot be a just law, but clear dishonesty. In law 
and justice, there is no likelihood of any interference. English Law is 
known as susceptible to any interpretation. Islamic law is the law of 
justice. It only tends to do justice. It is firm and not capable of 
being turned to any other side.<br />
